iOS App Addendum

These Terms are between you and SIGMA SIGMA HOLDINGS LLC — not Apple Inc. Apple is not responsible for Communly, the app, user listings, user content, payments, events, goods, services, support, maintenance, warranties, claims, or legal compliance.

Apple grants you a non-transferable license to use the Communly app on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service. That license is subject to the Usage Rules in Apple’s terms.

SIGMA SIGMA HOLDINGS LLC is solely responsible for providing maintenance and support for the Communly app. Apple has no obligation to furnish any maintenance or support services.

To the maximum extent permitted by applicable law, Apple has no warranty obligation for the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app, if any. Apple has no other warranty obligation whatsoever, and any other claims, losses, liabilities, damages, costs, or expenses attributable to a failure to conform to a warranty are solely SIGMA SIGMA HOLDINGS LLC’s responsibility.

SIGMA SIGMA HOLDINGS LLC, not Apple, is responsible for addressing any claims by you or a third party relating to the app or your possession or use of it, including product liability claims, any claim that the app fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy, or similar legislation.

If a third party claims the app infringes their intellectual property rights, SIGMA SIGMA HOLDINGS LLC — not Apple — is solely responsible for the investigation, defense, settlement, and discharge of that claim.

You represent that you are not located in a country subject to a U.S. government embargo or designated as a “terrorist supporting” country, and that you are not on any U.S. government list of prohibited or restricted parties.

Communly marketplace transactions involve real-world events, parties, dinners, services, memberships, and goods consumed outside the app. Under App Store rules, these are processed through Stripe or another permitted payment method, not Apple in-app purchase.

If we ever sell purely digital features used inside the app, those purchases may be required to use Apple’s in-app purchase system, and Apple’s payment, subscription, cancellation, and refund processes would apply to them. We do not currently sell such features.

The app contains user-generated content — listings, photos, descriptions, messages, questions, reviews, and club room posts. As required for apps with user-generated content, Communly provides:

• published terms making clear there is no tolerance for objectionable content or abusive users;
• a method to report objectionable content from any listing page;
• a method to block abusive users from any profile;
• a commitment to review reports and act within 24 hours, including removing content and ejecting the users who posted it; and
• published contact information so users can reach us directly.

You may not post objectionable, illegal, unsafe, abusive, or prohibited content. See our Safety & Community Policy.

The app provides an in-app way to delete your account, on the Profile page. See our Privacy Policy for exactly what deletion removes and what is retained for legal, tax, payment, and safety reasons.

Apple and Apple’s subsidiaries are third-party beneficiaries of this Addendum. Upon your acceptance of these Terms, Apple has the right — and is deemed to have accepted the right — to enforce this Addendum against you as a third-party beneficiary.
